1.1 Nose
1.1.1. The website www.noseparis.com (hereinafter the “ Site ") is published and operated by the company NOSE, a simplified joint stock company with capital of 111,340.90 euros, whose head office is located at 20, rue Bachaumont in 75002 Paris (France). 1.1.2. The Site is hosted by the companies:

1.2 The Customer
1.2.1. The products of the company NOSE are offered for sale to non-professional customers who have the status of final consumer (hereinafter “ Client(s) "). Within the meaning of the introductory article of the Consumer Code, the consumer is defined as:
« any natural person who acts for purposes which do not fall within the scope of his commercial, industrial, artisanal or liberal activity ».
1.2.2. Consequently, the Customer, prior to his order, declares that his purchase on the Site is not directly related to a professional activity and is limited to personal or family use. NOSE reserves the right to refuse any order for products that do not clearly correspond to a retail sale.
1.2.3. In addition, the Customer, prior to ordering, declares to be legally capable of entering into a sales contract and thus to pay the price of the order.
2. General provisions relating to these general conditions of sale
2.1 Purpose
2.1.1. The purpose of the General Conditions of Sale is, firstly, to inform the Customer about the conditions and terms of ordering, sale and delivery of the products offered for sale on the Site. Then, they govern the rights and obligations of the parties for the sale of products purchased by the Customer on the Site.
2.1.2. Before confirming an order, the Customer is systematically invited to read and accept the General Conditions of Sale. Consequently, placing an order for a product on the Site implies the Customer's full and unreserved consent to these General Conditions of Sale, who declares and guarantees having read and understood them. To this end, NOSE invites the Customer to carefully read the contractual provisions of the General Conditions of Sale. The Customer can read it before confirming his order. He can also access it from the Site section “ Aide ”, then clicking on “ CGV », located at the bottom of each page of the Site. 2.1.3. The General Conditions of Sale are supplemented by the General Conditions of Use of the Site (https://noseparis.com/en/terms-conditions-of-use), the Personal Data Protection Charter (https://noseparis.com/en/privacy) and the Cookies Charter (https://noseparis.com/en/privacy), also accessible from the footer of the site by clicking on “CGU" And "Confidentiality Policy " And "Cookies", located at the bottom of each page of the Site.
2.2 Domaine d’application
2.2.1. The General Conditions of Sale apply, without restriction or reservation, to all sales of all products offered by NOSE on its Site. The Customer acknowledges being informed that placing an order on the Site requires full payment..
2.2.2. The General Conditions of Sale are applicable exclusively to the distance selling of products sold from the Site, accessible freely and free of charge to any Internet user. They apply to the exclusion of all other conditions, in particular those in force for sales at the NOSE store.
2.3 Modifications
2.3.1. NOSE draws the Customer's attention to the fact that it may modify or update its General Conditions of Sale at any time.
2.3.2. In this case, the General Conditions of Sale will however only be enforceable against the Customer once they are posted online. Consequently, they cannot apply to contracts concluded previously. Thus, the applicable General Conditions of Sale are those in force at the time of the order and accepted as such by the Customer prior to his order confirmation on the Site.
3. Product
3.1 Product characteristics
3.1.1. The Site allows the Customer, by clicking on each product, to have a detailed description for all the products offered for sale by NOSE. In application of article L. 111-1 of the Consumer Code, the Customer can, prior to his order, become aware of the essential characteristics of the products he wishes to order. These are written in French, English, German, Italian, and Spanish. NOSE invites the Customer to contact it at +33 (0)1 86 47 72 76, by email to the address info@noseparis.com or go directly to the store located 20, rue Bachaumont 75002 Paris (France), for any questions regarding the products.
3.1.2. The Customer, if he wishes, is also invited to consult the section “ FAQ: Frequently Asked Questions » which deal in particular with perfumery and cosmetics and provide additional information on the products in these sectors.
3.2 Product availability
3.2.1 The products offered for sale on the Site are available within the limits of stocks of NOSE and/or its suppliers. However, NOSE does not have the ability to sell certain products outside the European Union. Their order will therefore not be accepted for any delivery outside the territory of the European Union.
3.2.2 If it turns out that the product ordered by the Customer is no longer available, NOSE will inform them as quickly as possible by e-mail and will cancel their order or pre-order, if the unavailability of the product continues for a period of thirty (30) days. The Customer will be fully reimbursed for the price of the unavailable product as well as any delivery costs paid for the unavailable product within 14 (fourteen) days of cancellation of the order or pre-order. However, if only part of the products ordered by the Customer is unavailable, the Customer will not be reimbursed for the delivery costs paid for the products available and delivered. This option of NOSE does not prevent the Customer from exercising his right of withdrawal according to the terms described in thearticle 10 General Conditions of Sale.
3.2.3 The Customer may also request to be informed of the return to stock of unavailable products. To do this, the Customer must register their email for this purpose. NOSE then sends him an email, within approximately 48 hours (working days), and indicates the product availability date. Once the product is available again, NOSE sends a new email to the Customer to inform them.
3.2.4 NOSE reserves the right to modify the catalog of products offered for sale on its Site without prejudice to orders previously placed by the Customer.
3.3 Product conformity
The products sold on the Site comply with French legislation in force at the time they are offered for sale.
4. Samples
4.1. The Customer can order samples of certain perfumes and cosmetics on the Site. Samples are free for the Customer. However, the Customer must pay the costs of preparation and packaging as well as, where applicable, delivery.
4.2. NOSE reserves the right to cancel any order for samples beyond use intended for the discovery of the product to which the sample corresponds. Consequently, NOSE reserves the right to refuse higher orders:
(i) 2 (two) samples of the same product; Or,
(ii) to 10 (ten) samples of different products.
4.3 Sample orders are subject to all provisions of these general conditions of sale.
4.4 When a minimum order is reached, NOSE offers the Customer samples according to the following thresholds:
(i) for an order whose total amount, excluding payment by gift card, possible delivery costs and once deducting any promotional advantages, is greater than or equal to 80 (eighty) euros including tax, 3 free samples;
(ii) for an order whose total amount, excluding payment by gift card, possible delivery costs and once deducting any promotional advantages, is greater than or equal to 160 (one hundred and sixty) euros including tax, 6 free samples;
5. Price
5.1 Sales price
5.1.1 The sales prices of the products appear on the Site by clicking on each of them. In accordance with article L. 112-1 of the Consumer Code, all prices indicated on the Site are displayed in euros (€), excluding participation, where applicable, in the payment of delivery costs. These delivery costs, and where applicable taxes, customs clearance fees and other applicable charges, are indicated to the Customer:
(i) to the address https://noseparis.com/fr/shipping ;
(ii) from the bottom of each page of the Site by clicking on “ Delivery methods », then selecting the country of delivery of the order;
(iii) before validation of the order.
They vary depending on the amount of the order, the weight or volume of certain products, the delivery method selected and/or the country of destination. Where applicable, they are invoiced in addition to the price.
5.1.2. If the Customer wishes to be delivered in France, the prices are displayed including Value Added Tax (VAT). If the Customer wishes to be delivered to one of the member countries of the European Union other than France, the prices are displayed including Value Added Tax (VAT) or excluding Tax (HT), depending on the tax regime applicable to the country of destination.
5.1.3. If the Customer wishes to be delivered to the United Kingdom, prices are displayed including Value Added Tax (VAT), customs taxes and “Brexit Fees”. The amount of the “Brexit Fee” varies depending on the total amount of the order and the delivery method selected, as they depend on the carrier. Details of customs taxes and Brexit Fees are available at https://noseparis.com/fr/shipping, from the bottom of each page of the Site by clicking on “ Delivery methods ”, then selecting “ United Kingdom ”, and in Appendix 2.2 of these General Terms and Conditions. If applicable, NOSE invites the Customer to inquire with the local authorities of the country of destination of the order on the terms of payment of Value Added Tax (VAT) and customs taxes or to attach it to +33 (0)1 86 47 72 76 or by email to the address info@noseparis.com.
5.1.4. If the Customer wishes to be delivered outside the European Union, the prices are always displayed excluding value added tax (HT), customs taxes or other specific charges applicable to the legislation of the importing country, exception of deliveries to DDP countries (please refer to article 9.2 and Appendix 2.1 of these General Terms and Conditions). Outside DDP countries, the Customer is required to pay Value Added Taxes (VAT), customs taxes or other specific fees applicable to the local authorities themselves upon delivery of the order. When the carrier has previously paid the Value Added Tax (VAT), customs taxes or other specific charges applicable, the Customer is required to reimburse, upon proof, the total corresponding amount to the carrier. In any case, the Customer acknowledges being informed that NOSE cannot be considered liable for Value Added Tax (VAT), customs taxes or specific applicable fees. NOSE invites the Customer to inquire with the local authorities of the country of destination of the order on the terms of payment of applicable customs duties or to attach it to +33 (0)1 86 47 72 76 or by email to the address info@noseparis.com
5.1.5. The total amount owed by the Customer excluding delivery costs, Value Added Tax (VAT), customs taxes and/or specific fees applicable, is indicated before he definitively validates his order, for the first time in the section “ Basket ". Then, after clicking on “ Order with payment obligation » and provided the information necessary to process the order, in the section “ Verification », including this time any delivery costs.
5.2 Current prices and modification
5.2.1 The sales prices in force are those displayed on the Site on the day of the order.
5.2.2 NOSE, however, reserves the right to modify its prices at any time while guaranteeing the application of the price in force at the time of the order subject to the availability in stock of the product at the time of the order. Thus, in the event that the pre-order is canceled due to a prolonged out of stock of the product according to the terms of article 3.2.2, the Customer who places a new order for the product does so at the displayed price. on the day of the new order.
6. Order
6.1 Order process
6.1.1 Beforehand, the Customer must log into their NOSE personal account to place and finalize their order. If the Customer has not yet created an account, he or she is invited to create a personal NOSE account. The terms and conditions for creating a NOSE personal account are set out in the General Conditions of Use of the Site (https://noseparis.com/fr/conditions-generales-d-usage). In addition, NOSE invites the Client to read the terms of protection of the Client's personal data (https://noseparis.com/fr/privacy).
6.1.2 The Customer places an order from the Site. The Customer can select the products he wishes to purchase by clicking on “ Add ". The Customer is then invited to select “ Continue shopping » or « go to cart ».
6.1.3 All selected products are collected in the “ Basket » from which the Customer can check the details of the order and its total price excluding delivery costs. The Customer can also consult the General Conditions of Sale, correct his order by modifying the “ Basket » and return to previous pages using its search engine.
6.1.4 Always since the “ Basket », the Client has the option:
(i) to enter a “ Promotional code » which the Customer will have previously received by email following the purchase of a kit of 5 (five) samples. Entering this code in the appropriate insert allows the Customer to benefit from a 12 (twelve) euros reduction on the purchase price of a product on the Site, excluding samples, for their first order. The Customer cannot combine several promotional codes for the same order. In addition, the Customer cannot use his “ Promotional code » when he uses his “ balance Gift Card » or a “ Gift Card ».
(ii) to use the “ balance Gift Card » associated with their personal NOSE account by checking the box “ Use my Gift Card scale » or activate a “ Gift Card » of which the Customer is the beneficiary by entering the code associated with this card in the appropriate box. The use of the “ balance Gift Card » or the activation of the “ Gift Card » will automatically deduct the associated balance from the price of the order. The Customer can accumulate his “ balance Gift Card » and one or more “ Gift Card » for the same order.
6.1.5 After checking the contents of the “ Basket », the Customer is invited to click on the icon “ Order with payment obligation ". He is also asked to provide the billing, delivery and payment information necessary to process his order. Once this information has been provided, the Customer arrives at the “ Verification » summarizing the products ordered, the total price including, where applicable, Value Added Tax and any delivery costs. The order will only be final after the Customer has first accepted the General Conditions of Sale by checking the appropriate box, then confirmed his order by clicking on the “ Confirm order ". From then on, the Customer agrees to be bound by a sales contract concluded with NOSE. Confirmation of the order entails unreserved acceptance of its characteristics, the General Conditions of Sale and the General Conditions of Use of the Site.
6.1.6 NOSE confirms by sending a first email to the Customer at the address indicated the acceptance of the order containing the order form and a link to the General Conditions of Sale. A second email will be sent to the same email address when the order is shipped. Consequently, the Customer undertakes to provide NOSE with an exact email address.
6.1.7 In the event that a product is not available, the Customer has the option of pre-ordering it on the Site. To do this, the Customer orders the product under the same conditions as if the product were available (see articles 6.1.1 to 6.1.5). NOSE then sends him an email within 24 hours (working days) and indicates an availability date for the product(s) ordered as well as the date the order was sent. Once the product is available again, the order is shipped, accompanied by the emails sent as part of a normal order (see article 6.1.6).
6.2 Cancellation of order
6.2.1 If the Customer wishes to cancel his order, NOSE invites him to follow the steps provided for the withdrawal procedure at thearticle 10 « RETRACTATION » General Conditions of Sale.
6.2.2 In the event of an order placed with a bank card whose status is “3D attempt” or “3D not enrolled”, and/or the country of delivery indicated does not correspond to the country of the holder of the bank card used for payment, NOSE reserves the right to ask the Customer for confirmation of receipt of an amount credited by NOSE, which must then be compensated, on the account to which the card used for payment is linked, of an amount between 0 and 1 euro,
6.2.3 NOSE reserves the right to suspend or cancel the execution of an order in the event of failure to pay the price in full, fraud or attempted fraud, and failure to collect a delivered or “Pickup” order. within contractual deadlines (see article 9.6), including in connection with a previous order.
6.3 Archiving and proof
6.3.1 In accordance with article 1379 of the Civil Code, the archiving of communications, orders and invoices is carried out by NOSE on a reliable and durable medium so as to constitute a faithful and durable copy.
6.3.2 NOSE also invites the Customer to keep a copy on a reliable and durable medium of the elements relating to their order and delivery such as paper or digital media.
7. Payment
7.1 Obligation to pay
NOSE reminds that the confirmation of an order implies the obligation for the Customer to pay the price of the products ordered and, where applicable, delivery. In this regard, the Customer declares and guarantees to NOSE that he has the necessary means and authorizations to use the payment method used.
7.2 Terms
7.2.1 The payment methods accepted on the Site are displayed from the “ Basket ". Payment for the order is made by credit card, via Apple Pay or Google Pay or through the Customer's PayPal account.
7.2.2 When paying by credit card, only cards from the VISA, MasterCard and AMEX network are accepted. Any bank charges and commissions are the sole responsibility of the Client. Payment by credit card is made via the secure website called MERCANET of the banking establishment BNP PARIBAS. This site applies 3D SECURE banking security. Depending on the banking establishment, the Customer may be redirected to an authentication page of their bank before validation of their payment.
7.2.3 The Customer can also use the “ balance Gift Card » associated with their personal NOSE account or activate a “ Gift Card » from which he is the beneficiary to pay all or part of the price of his order up to the credit amount according to the terms provided for in thearticle 6.1.4 (iii) above. Where applicable, if the balance of the “ balance Gift Card » or the “ Gift Card » does not allow full payment of the price of the order, the excess must be paid by the Customer according to the terms of the order.article 7.2.1 General Conditions of Sale.
7.2.4 Gift cards obtained by the Customer in store can be used on the Site to pay the price of the order.
7.2.5 Using gift cards to pay for the order price does not count toward the amount toward free shipping and/or free samples.
8. Reservation & ownership
The products ordered remain the property of NOSE until full payment of their price, all taxes included, by the Customer.
9. Delivery & receipt
9.1 Delivery location
9.1.1 Delivery of the ordered products will take place, after payment of the amount of the order, to the delivery address indicated by the Customer. Consequently, the Customer undertakes to communicate an exact delivery address to NOSE. When the Customer provides incorrect delivery details and additional delivery costs are requested by the carrier from NOSE to make a new delivery, NOSE will inform the Customer; the Customer then has the choice between:
(i) request a new delivery of the order, subject to prior payment of additional delivery costs, regardless of the amount of the order, and even if the costs of the first delivery were initially offered;
The amount of delivery costs are specific to the delivery method chosen by the Customer and will be communicated to them before any new delivery of the products ordered. Payment must be made within a period indicated by NOSE, using one of the payment methods accepted on the Site; Or,
(ii) to exercise their right of withdrawal, according to the terms of thearticle 10 General Conditions of Sale.
In the event that the Customer does not respond to NOSE within the allotted time, the order will be automatically returned to NOSE by the carrier. Within 10 (ten) to 14 (fourteen) days following receipt by NOSE of the package, NOSE will reimburse the price of the Customer's order, less delivery costs, which remain entirely its responsibility.
9.1.2 Any change to the delivery address indicated on the order must be indicated by the Customer in writing. It will be done under his full responsibility. In the event that the delivery costs resulting from the change are greater than those originally paid by the Customer, NOSE will inform the Customer. However, NOSE will only be required to apply this change to the extent that it is still reasonably possible at the time of its notification.

DDP COUNTRY SPECIFICS
Specific delivery terms apply to the following destination countries (the "DDP Countries"):

These specific conditions are described in Article 9.3.1 and in Appendix 2.1 and 2.2 of the GTC.
9.3 Terms of delivery
9.3.1 Before confirming its order, the Customer chooses the delivery method it wishes from among the five methods listed below.
DDP country specifics
In DDP Countries, with the exception of the United Kingdom (please refer to Annex 2.2), the only available delivery methods are:
- For sample orders: delivery by Priority Mail;
- For product orders: delivery by DHL only.
Store Pickup
The Customer may choose to pick up their order from the NOSE store located at 20, rue Bachaumont, 75002 Paris (France) during opening hours from Monday to Saturday between 10:30 and 19:30, except public and bank holidays. Prior to pickup, the Customer will receive an email from NOSE to inform them that the order is ready. NOSE hereby informs the Customer that they must present valid identification papers to withdraw the order from the store.
Courier Delivery (only for Paris & Ile de France)
Courier delivery is carried out by the company Top Chrono. It is carried out without a tracking number and with hand delivery directly to the Customer. Beforehand, the Customer is required to confirm by telephone or email to NOSE his postal address and provide all the information necessary for the delivery of the order, as well as the delivery time slot. Subject to this reservation, delivery generally takes place within three (3) hours from the moment the order is deemed to have been validated and prepared. On the day of delivery, NOSE contacts the Customer to confirm the delivery instructions and terms (detailed address, date and time slot during which delivery will be made).
In order to guarantee the integrity of the delivered order, the order is, before being handed over to the Courier, prepared and checked by NOSE (references and quantities). On this occasion, NOSE places the ordered products into a NOSE bag which is then closed with staples and / or sealed with "vinyl" stickers on which the NOSE logo is affixed. The bag thus prepared is weighed by NOSE and its weight is entered on the Top Chrono platform before being handed over to the Courier.
Products of the same order are subject to a single delivery service.
NOSE also informs the Customer that:
(i) only the person who made the order or, if not available, a person authorized and identified by the Customer during the call, is authorized to take delivery,
(ii) the ordered products are sealed with staples and/or « vinyl » stickers; otherwise, the delivery must be immediately refused by the Customer,
(iii) it is up to the Customer to check the content of the delivery and to check the conformity and the absence of visible defects of the products delivered after the order.

Delivery by Tracking Letter
The delivery by Tracked Letter is carried out by the company La Poste SA. It is carried out with a tracking number, but without delivery against signature by the Customer. This shipping method is available exclusively for sending samples ordered on the Site. Delivery takes place within 3 to 11 working days, depending on the destination.
NOSE draws the Customer's attention to the fact that for certain destinations (eg Romania, Scandinavian countries, Baltic States, Balkans, South America including Chile, South Korea, India, etc.) detailed in the “Shipping Methods”, the delivery times by Tracked Letter may vary for exceptional reasons up to 30 working days (eg sporadic delivery, constraints resulting from restrictions linked to the COVID-19 pandemic, etc.).
Delivery by Colissimo
Delivery by Colissimo is carried out by La Poste SA. It is carried out with a tracking number regardless of the destination and, in France only, with delivery against the Customer's signature (except for constraints resulting from restrictions related to the COVID-19 pandemic or various reasons given by the carrier).
Delivery takes place:
(i) in mainland France, Corsica and Monaco within 48 working hours,
(ii) within 8 (eight) working days in the European Union, Monaco, Switzerland, and the United Kingdom,
(iii) within 12 (twelve) working days in any other country,
from the date on which the preparation of the order by NOSE is finalized and confirmed to the Customer by sending an email.
NOSE draws the Customer's attention to the fact that for certain destinations (eg Romania, Scandinavian countries, Baltic States, Balkans, South America including Chile, South Korea, India, etc.) detailed in the Shipping Methods, Colissimo delivery times may vary for exceptional reasons up to 30 working days (eg sporadic delivery, constraints resulting from restrictions linked to the COVID-19 pandemic).
Delivery by Colissimo is offered by NOSE for any order over 66.66 (sixty-six point sixty-six) euros excluding taxes to Member States of the European Union.
SPECIFIC TERMS FOR DELIVERY BY COLISSIMO
Some products whose volume or weight exceeds the limits of a package considered "standard" by the carrier may result in higher transportation costs and therefore the application by the carrier of a specific rate called "volumetric weight surcharge" of 5€, 10€ or 20€, depending on the products and/or orders. The Customer is invited to refer to the page https ://noseparis.com/en/shipping to consult the complete list of Products concerned. These volumetric weight surcharges apply regardless of the country of destination of the delivery and are payable by the Customer, including when the delivery charges are offered by NOSE.

Delivery by DHL
Delivery by DHL is carried out by the company DHL International Express (France) SAS. It is carried out with a tracking number and delivered against the Customer's signature.

SPECIFIC TERMS AND CONDITIONS FOR DELIVERY BY DHL
All deliveries made by DHL involve the payment of specific fees related to the transport of hazardous materials (so-called "DGD fees"), in the amount of 5 euros per order. These DGD charges apply regardless of the country of destination of the delivery and are payable by the Customer, including when delivery charges are offered by NOSE.
Some products whose volume or weight exceeds the limits of a package considered "standard" by the carrier may result in higher transportation costs and therefore the application by the carrier of a specific rate called "volumetric weight surcharge" of 5€, 10€ or 20€, depending on the products and/or orders. Delivery by DHL is taken in charge by NOSE for any order above 133.33 euros excluding VAT for the majority of the Member States of the European Union. The modalities for free shipping by DHL are explained more broadly on the Shipping Methods page of the Site, detailing the delivery fees per country. They are also listed in the general conditions of sale and are accessible at the bottom of each page of the Site by clicking on Shipping Methods.
9.3.2 When the Customer chooses delivery by Tracking Letter, Colissimo or DHL, NOSE communicates the tracking number to the Customer by email. With this number the Customer can track the transport and delivery of the parcel.
9.3.3 Deliveries by Lettre Suivie, Colissimo and by DHL made outside mainland France may be made by local partners of the companies La Poste SA and DHL International Express (France) SAS. Consequently, the delivery terms of the products may vary from one country to another. In addition, if the Customer wishes to be delivered outside a member country of the European Union, delivery times do not take into account, where applicable, customs clearance times for the products ordered. NOSE invites the Customer to obtain information from local post services and carriers or to contact it at the number +33 (0)1 86 47 72 76 or by email to the address info@noseparis.com to obtain additional information.
9.4 Delay or failure to deliver
9.4.1. The delivery times specified inarticle 9.3 of the General Conditions of Sale will be automatically suspended by any force majeure event resulting in delay of delivery. NOSE will keep the Customer informed, within a reasonable time, of cases and events likely to disrupt the delivery process of the ordered products.
9.4.2 Except in cases of force majeure or fault of the Customer, if the order is not delivered within the time limits specified in thearticle 9.3 of the General Conditions of Sale, the Customer has the right to request the cancellation of his order according to the terms provided for by article L. 216-2 of the Consumer Code, namely that:
(i) the Customer must give NOSE formal notice to deliver his order according to the same delivery terms. If delivery does not take place within a reasonable additional period of time, the sale will be automatically canceled;
(ii) if the Customer demonstrates that the delivery time was an essential condition of the contract, he may immediately cancel his order.
To exercise one of these rights, the Customer must send NOSE a registered letter with acknowledgment of receipt to 20, rue Bachaumont in 75002 Paris (France) or an email to the address info@noseparis.com. NOSE will reimburse the amount of the order and delivery costs within 14 (fourteen) days from the date of receipt of the letter or email from the Customer. However, if delivery of the order occurs in the meantime, the order must be returned by the Customer to NOSE. The return costs paid by the Customer will then also be reimbursed to the Customer within the same period.
9.4.3 If the Customer asks the delivery company to deliver their order without requiring a signature, or with the signature of a third party, they will assume all the consequences and will be solely responsible for the products. To the extent that some local partners of La Poste SA and DHL International Express (France) SAS do not systematically require a signature at the time of receipt of the package, if the Customer has not received his order although the carrier indicates it as delivered, the Customer must file a handrail, complaint or his equivalent to the local authorities of their country of residence. The Customer declares and guarantees to be informed that if they do not follow this approach, they will not be able to claim a refund of the order, nor a new delivery of the products, without prejudice to their right of withdrawal according to the terms provided for in thearticle 10 General Conditions of Sale.
9.5 Reserves on delivery
9.5.1. The risk of loss or damage to the products is transferred at the moment when the Customer or the recipient of the order takes physical possession of the delivery.
9.5.2 NOSE invites the Customer or the recipient of the order, upon receipt, to check, on the one hand, that the package does not present any anomaly or damage of any kind, and on the other hand, the conformity and absence any apparent defect in the products delivered to the order. When the package is damaged, the Customer must refuse delivery and not open the package. In addition, the Customer must, on the one hand, express reservations and describe the damage noted precisely and completely on the delivery note, and report it to NOSE. Likewise, if the products delivered do not conform to those ordered by the Customer, he must inform NOSE upon receipt. With regard to delivery by Courier, it is specified that the Customer must carry out the checks mentioned in this article, and notify NOSE at the latest the day after the day of delivery of the order – deadline postponed to the Monday following the delivery if it took place on a Saturday. 9.5.3 The Customer declares and guarantees to be informed that if he does not follow the steps in the above-mentioned article, he will not be able to claim either a refund of the order or a new delivery of the products, without prejudice to his right of withdrawal according to the terms provided in L'article 10 General Conditions of Sale.
9.6 Failure to collect ordered products within the time limit set by the Customer
9.6.1. When the Customer has chosen delivery by Colissimo or DHL, in the absence of the Customer or the recipient of the order, a delivery notice is left by the carrier, indicating the address allowing the package to be collected within a certain period. This period is, in principle, 15 (fifteen) days. However, it may vary depending on the local particularities of the country of delivery. NOSE invites the Customer to obtain information from local post services and carriers or to contact it at the number +33 (0)1 86 47 72 76 or by email to the address info@noseparis.com to obtain additional information.
9.6.2 In the event that the Customer or the recipient of the order does not collect the package within the allotted time, it will be automatically returned to NOSE by the carrier. Within 10 (ten) to 14 (fourteen) days following receipt by NOSE of the package, NOSE will reimburse the price of the Customer's order, less delivery costs, which remain entirely its responsibility. However, within this same period, the Customer has the option of requesting a new delivery of the ordered products from NOSE. In this case, the Customer will have to pay the costs of the new delivery, regardless of the amount of the order, and even if the costs of the first delivery were initially offered. The amount of delivery costs are specific to the delivery method chosen by the Customer and will be communicated to them before any new delivery of the products ordered.
9.6.3 When the Customer has chosen “Pickup” in-store collection, the order must be collected from the NOSE store located 20, rue Bachaumont in 75002 Paris (France) during opening hours, i.e. Monday to Saturday, from 10:30 a.m. to 7 p.m. 30 hours, excluding public holidays, within a maximum period of 6 (six) months from receipt of the email informing them that their order is ready. Failure to collect within this period will be considered a fault on the part of the Customer, leading to the cancellation of the order at their exclusive expense without them being able to claim any reimbursement.
10. Retractation
10.1 Rights and withdrawal periods
10.1.1 Pursuant to article L. 221-18 of the Consumer Code, the Customer has, without having to provide reasons, a period of fourteen (14) days from receipt of delivery of the order to exercise your right of withdrawal. When the fourteen (14) day period expires on a Saturday, Sunday or public holiday, it is extended until the first following working day.
10.1.2 In application of article L. 221-28 5° of the Consumer Code, the Customer has no right of withdrawal once the perfumery and cosmetic products have been unsealed after their delivery. Thus, for reasons of hygiene and safety, any perfumery and cosmetic product which has been opened, unsealed, unsealed or damaged, including its packaging, will not be refunded, returned or exchanged. However, the Customer is not deprived of the legal guarantees of conformity and hidden defects.
10.1.3 NOSE reserves the right to check the batch number of any product returned by the Customer as part of exercising their right of withdrawal, in order to ensure that it is the product shipped. Any returned product whose batch number does not correspond to the batch number of that sent to the Customer will not be refunded, taken back or exchanged.
10.2 Conditions for exercising the right of withdrawal
10.2.1 To exercise his right of withdrawal, the Customer must:
(i) inform NOSE of its decision to exercise its right of withdrawal within a period of fourteen (14) days from receipt of delivery of the order by sending a letter to the address 20, rue Bachaumont 75002 Paris (France) or an email to info@noseparis.com.
The Customer can use the detachable withdrawal form below by Appendix 1. Failing this, the Customer must always indicate the order number on their mail or email.
(ii) once NOSE has been informed of the decision to exercise its right of withdrawal, the Customer must return the product(s) concerned within a period of fourteen (14) days from sending the declaration of withdrawal, either by going to the NOSE store, or by post, at 20, rue Bachaumont, 75002 Paris (France).
The products must be returned in their original packaging, in perfect condition and accompanied by all accessories and documents provided. Otherwise, returned products will not be refunded.
10.2.2 Any shipping costs for the product(s) to NOSE remain the exclusive responsibility of the Customer for all countries except France, and unless:
(i) the Customer has chosen the delivery method collection in store « Pickup » ;
(ii) the delivery does not comply with the order.
NOSE will refuse mail or packages sent postage collect.
10.2.3 NOSE recommends that the Customer return the product(s) by a mode of transport that allows tracking of the package and provides a certain date. Indeed, the risk of damage or loss of the returned product(s) is borne by the Customer.
10.3 Effects of withdrawal
10.3.1 Pursuant to article L. 221-24 of the Consumer Code, NOSE will reimburse the Customer the price of the returned product(s), including delivery costs unless the consumer has expressly chosen a cheaper delivery method. expensive than the standard delivery method, at the latest within 14 (fourteen) days from the date NOSE was informed of the Customer's desire to withdraw. 10.3.3 The benefits obtained when purchasing the returned product(s) will, where applicable, be canceled, including:
(i) free delivery in the event that a partial withdrawal would bring the total amount of the order below the free delivery threshold (cf. article 9.2 of the General Conditions of Sale). In such a case, NOSE will reimburse the principal overpayment of the order, less the applicable delivery costs;
(ii) free sample preparation and packaging costs in the event that a total or partial withdrawal would cause the total amount of the order to fall below the threshold giving the right to receive this advantage (cf. article 4.4 of the General Conditions of Sale). In such a case, the Customer is required to return to NOSE :
in the event of total withdrawal, all of the samples delivered;
in the event of partial withdrawal, bringing the total amount of the order excluding any delivery costs and once any promotional benefits have been deducted, below the threshold of:
160 (one hundred and sixty) euros including tax three: (3) of the six (6) samples delivered, at the Customer's choice;
80 (eighty) euros including tax, all samples delivered.
Samples must be returned according to the terms of thearticle 10.2.1 (ii) of the General Conditions of Sale, simultaneously with the returned product(s). Failing this, a unit price per sample of three (3) euros will be deducted from the amounts reimbursed to the Customer.
10.3.4 The Customer acknowledges being informed that the reimbursement, made in accordance with the articles 10.2 and 10.3.1 General Conditions of Sale:
(i) does not include the reimbursement of any bank charges paid by the Customer when placing their order, which remain the exclusive responsibility of the latter;
(ii) in the event that the order was paid in a currency other than the euro, is carried out by NOSE at the exchange rate in force, applied to the total amount received by NOSE in execution of the sums paid by the Customer.
11. Guarantees
11.1 NOSE informs the Customer that he benefits (i) a legal guarantee of conformity, in application of articles L. 217-3 et seq. of the Consumer Code, the terms of which are specified in the box below, and (ii) of the legal guarantee relating to hidden defects, in application of articles 1641 et seq. of the Civil Code for all products sold on the Site. The legal guarantees apply in any case in compliance with the conditions which govern them.

11.2 Legal guarantee of conformity
Pursuant to article L. 217-3 of the Consumer Code and from the delivery of the goods, NOSE responds to defects of conformity appearing within a period of 2 (two) years:
(i) on the product itself;
(ii) resulting from the packaging when this was made his responsibility by the contract or was carried out under his responsibility.
11.2.1 To comply with the contract, the product must:
(i) correspond to the description, type, quantity and quality or any other characteristic provided for in the contract – NOSE guarantees in particular the authenticity of the products it distributes, as well as their official provenance;
(ii) be suitable for the use usually expected of goods of the same type, taking into account whether there are legal provisions, technical standards and/or specific codes of conduct applicable;
(iii) where applicable, possess the qualities that NOSE presented to the Customer in the form of a sample or model before the conclusion of the contract;
(iv) be delivered with all accessories, including packaging, that the consumer can legitimately expect;
(v) correspond to the quantity, quality and characteristics, including in terms of durability, functionality, compatibility and safety, that a buyer can legitimately expect from goods of the same type, having regard to the nature of the product as well as public statements made by NOSE, particularly in advertising or labeling;
(vi) present the characteristics defined by mutual agreement by the parties or be suitable for any special use sought by the Customer, brought to the attention of NOSE at the latest at the time of conclusion of the contract and which the latter has accepted.
11.2.2 Defects of conformity which appear within a period of 24 (twenty-four) months from the delivery of the goods are, unless proven otherwise, presumed to exist at the time of delivery of the latter, unless this presumption is incompatible with the nature of the good or defect invoked.
11.2.3 The Customer will not be able to contest the conformity of a product by invoking a defect concerning the particular characteristics of a product which deviate from the conformity criteria set out in article 11.2.1 of which he has been specifically informed by NOSE and to which he expressly and separately consented when concluding the contract. In this regard, NOSE does not guarantee Customer satisfaction and in particular the performance of perfumery products. In the event of dissatisfaction with these criteria, the Customer is invited to contact the manufacturing companies, whose contact details may be provided by NOSE, in order to formulate their complaints.
11.2.4 When, in the course of a contract, processing of personal data is carried out by NOSE and the latter fails to fulfill its obligations in accordance with Regulation (EU) 2016/679 of April 27, 2016 and Law no. °78-17 of January 6, 1978 relating to computing, files and freedoms, leading to non-compliance with one or more product conformity criteria set out in point 11.2.1, this failure is assimilated to a lack of compliance.
11.2.5 The conformity guarantee allows the Customer to obtain a free replacement of the product with an identical product, subject to available stocks. Given the nature of the products sold on the Site, the Customer will not be able to obtain repair of his product, this being impossible or likely to result in disproportionate costs for NOSE. If the replacement is impossible, if it could not be implemented within the period of 30 (thirty days) following its acceptance, if the non-conformity persists despite the replacement of the product or if the non-compliance compliance is of particular seriousness, NOSE will reimburse the Customer the price of the product on the basis of the total price invoiced including tax and delivery costs, as well as return costs on receipt, unless the Customer informs it in advance in writing of his decision to obtain a reduction in the price of the product. If the lack of conformity only concerns certain products delivered under the sales contract, the Customer has the right to terminate the contract for all of the products in this contract, if the Customer cannot reasonably be expected to he agrees to keep only the compliant products.
11.2.6 In the event of replacement of the product, the legal guarantee of conformity is renewed for 2 (two) years from the delivery of an identical replacement product.
11.2.7 In the event of termination of the contract, NOSE will reimburse the sums due to the Customer at the latest within fourteen (14) days following receipt of the product or proof of its return by the Customer, using the same payment method as that used during procurement. In particular, if the Customer used a gift card to pay for all or part of the products concerned, the balance used will be credited back to his gift card and the remainder according to the payment method used.
11.2.8 With regard to samples, in the event that the Customer does not receive a sample, or receives a sample that has leaked or whose name is illegible, NOSE, at the Customer's option, will reimburse the preparation and packaging costs. as well as, where applicable, delivery times having been applied, or will allocate a sample at no additional cost to be applied to their next order.
11.3 Legal guarantee relating to hidden defects
Pursuant to article 1648 paragraph 1 of the Civil Code, the Customer may implement the guarantee of hidden defects with regard to NOSE within a period of two (2) years from the discovery of a defect affecting a product.
11.3.1 Hidden defects constitute hidden defects in the product sold which make it unfit for the use for which it is intended, or which reduce this use to such an extent that the Customer would not have acquired it, or would have only paid a lower price for it. , if he had known them.
11.3.2 To exercise warranty action for hidden defects, the Customer must prove that the defect existed at the time of purchase, that it was hidden and that it renders the product unusable.
11.3.3 The Customer may choose between canceling the sale, in which case NOSE will reimburse the Customer the price of the product on the basis of the price invoiced including tax and delivery costs, or a reduction in the price.
11.3.4. In the event of termination of the contract, NOSE will reimburse the sums due to the Customer at the latest within fourteen (14) days following receipt of the product or proof of its return by the Customer, using the same payment method as that used during procurement. In particular, if the Customer used a gift card to pay for all or part of the products concerned, the balance used will be credited back to his gift card and the remainder according to the payment method used.
12. Intellectual property
12.1 The Site as a whole, as well as the products and their packaging sold there, and each of the visual or audio elements which compose it (namely in particular the brands, logos, designs and models, illustrations, photographs, texts, animations, videograms, phonograms, software, source codes and databases) are the exclusive property of NOSE or the holders of the intellectual property rights concerned. All these elements are protected by copyright, trademark law, design law, patent law as well as rights of his kind.
12.2 Consequently, any reproduction, communication, downloading, modification or total or partial use of one of these elements belonging to NOSE or a third party, for any reason and for any medium whatsoever, requires the prior written authorization of NOSE or their owners, except where permitted by law. The Customer declares and guarantees to be informed that in the event of failure to comply with any of these obligations, he is exposed to legal proceedings before the civil and/or criminal courts.

15.1 NOSE undertakes to perform its obligations resulting from the General Conditions of Sale in good faith.
15.2 NOSE draws the Customer's attention to the fact that its liability cannot be sought if the non-performance of its obligations resulting from the General Conditions of Sale results from the fault of a third party, the Customer or the occurrence of an event of force majeure.
16. Disputes
16.1 In the event of a dispute arising during the order or delivery of the products, the Customer has the possibility, before any legal action, to resort to an amicable solution and in particular to a conventional mediation procedure or any other method. alternative dispute resolution.
16.2 Pursuant to article 16.1:
(i) the Customer and/or NOSE can resolve a dispute through the Online Dispute Resolution platform set up by the European Commission, accessible at the following address: https://webgate.ec.europa.eu/odr/.
From this platform, the parties can file an online appeal against the other, who will be informed. The Client and NOSE will together choose an extrajudicial dispute resolution body to which the Dispute Resolution platform will transmit the dispute.
(ii) the Customer can also submit his complaint to the Consumer Mediator of the “National Chamber of Mediation Practitioners”, designated for disputes concerning the distance selling of products between professionals and consumers according to the terms provided for in articles L. 612-1 et seq. of the Consumer Code, accessible at the following address: https://www.cnpm-mediation-consommation.eu/. From this page, you can submit your mediation request online or by mail.
However, the Mediator may only be contacted by the Customer if no satisfactory response has been given to the written complaint that he has previously sent to Nose by email to the address info@noseparis.com or by mail to 20, rue Bachaumont in 75002 Paris (France), within one year of this complaint, and provided that the same dispute has not already been submitted to a Court or a Mediator.
16.3 If the Customer wishes to dispute a delivery, in particular the delivered status of an order indicated by a delivery company, he must provide NOSE with the following two documents:
(i) proof of filing a handrail at the Police Station, or its equivalent in the Customer's country of residence;
(ii) a declaration on honor stating the absence of delivery of the order.
16.4 The sales contract concluded between NOSE and the Customer as well as these General Conditions of Sale are subject to French law. In the event of a dispute, the French courts have jurisdiction.
16.5 However, if the Customer resides in a State other than France, he cannot be deprived of the protection provided to him by the mandatory rules of the legislation of his country of residence.

APPENDIX 2.1: DELIVERY TO DDP COUNTRIES
Specific delivery conditions apply to the following countries, known as "DDP countries (acronym of "Delivered Duty Paid"); this mechanism allows :
(i) when placing your order, NOSE automatically adds the following fees and taxes to the price of the selected products:
DGD fees (5 euros), when DHL provides transport;
Customs anc clearance fees (variable by country, see table below);
Other applicable local taxes (varies by country, e.g. Value Added Tax).
(ii) When you pay for your order, NOSE pays these fees and taxes to the carrier at the same time; thus, you do not have to pay anything to the carrier at the time of delivery of your order.
